Terms of Service

These Terms of Service ("Terms") govern access to and use of the services provided by Berta Mas Bistuer (Sole Trader), established under the laws of Spain ("Canvasana", "we", "us", or "our"). By registering for, accessing, or using our services, you ("Customer", "you") accept and agree to be bound by these Terms.

1. Scope

These Terms apply to all contracts between Canvasana and Customer relating to the use of Canvasana's online software-as-a-service platform (the "Services").

2. Services

2.1 Canvasana provides a cloud-based platform for creating and managing custom yoga sequence designs and flows.

2.2 We do not guarantee uninterrupted availability of the Services or that they will meet your specific expectations.

3. User Accounts and Registration

3.1 Use of the Services requires creation of a personal user account ("Account") using our authentication provider (Supabase). You must provide accurate and complete information.

3.2 You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your Account.

4. Customer Obligations

You agree not to:

(a) use the Services in a manner that violates any applicable Spanish or international law;

(b) upload or transmit content that infringes the intellectual property rights of others;

(c) interfere with the proper working of the Services; or

(d) share your Account credentials.

5. Paid Services and Subscription

5.1 Canvasana offers paid subscription plans for access to certain features ("Paid Services").

5.2 Pricing is available in-app via the Polar.sh pricing page and excludes applicable Spanish VAT unless otherwise stated.

5.3 Payments are handled via our payment processor, Polar.sh, and must be made in advance. Subscriptions automatically renew unless cancelled prior to the renewal date.

5.4 You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing cycle, and no refunds are provided for partial billing periods.

6. Intellectual Property Rights

6.1 Canvasana Content: We retain all intellectual property rights in and to the Services (software, branding, code, design, etc.). We grant you a limited, non-exclusive, non-transferable license to use the Services during the term of your active subscription.

6.2 Customer Content: You retain all intellectual property rights in the content, data, and files you create, upload, or manage through the Services ("Customer Content"). You grant Canvasana a worldwide, royalty-free license to use, host, reproduce, and modify the Customer Content only as necessary to provide, operate, and improve the Services.

7. Limitation of Liability

7.1 Our liability for damages shall be limited in accordance with applicable Spanish law. We are liable for damages caused by intent or gross negligence. For simple negligence, our liability is limited to foreseeable damages typical for this type of contract.

7.2 Canvasana shall not be liable for indirect, consequential, or special damages, lost profits, lost data, or business interruption.

8. Data Protection

We process personal data in accordance with the GDPR and our Privacy Policy, which is incorporated by reference into these Terms.

9. Term and Termination

9.1 This Agreement remains in effect as long as you have an active Account or subscription.

9.2 You may delete your Account at any time.

9.3 We may terminate this Agreement or suspend your access immediately if you breach these Terms or fail to make payment when due.

10. Governing Law and Jurisdiction

These Terms and any disputes arising out of or in connection with them shall be governed by and construed in accordance with the laws of Spain, without regard to its conflict of law principles. The parties agree that the Courts of Spain shall have exclusive jurisdiction over all disputes arising from these Terms.
